Pheasant Points Terms of Use

These Terms of Use (the "Agreement") govern participation in the "Pheasant Points" program offered by Flying Labs (the "Project"). By participating in or using this program, Users agree to be bound by these terms.
1. Definitions
The terms used in this Agreement are defined as follows:
"Project" refers to Flying Labs and its associated services.
"User" means any individual or entity who uses or participates in the Project.
"Pheasant Points" refers to a unique metric granted to Users based on their actions and contributions within the Project.
2. Nature of Points
Pheasant Points are a non-monetary metric and do not constitute legal currency, cryptocurrency, securities, or any other form of financial asset.
Points are calculated, granted, and managed solely at the discretion of the Project. The quantity of Points granted to any User may be adjusted, recalculated, or revoked without prior notice due to changes in policy, system updates, fraud prevention, or other operational reasons.
Points are non-transferable and may not be sold, exchanged, or redeemed for cash or any equivalent. Any language suggesting that Points may be linked to future rewards or distributions shall not create any binding rights or obligations.
3. Granting and Calculation of Points
Pheasant Points are granted based on user actions, contributions, and other criteria defined by the Project.
The methods for calculating points, the scope of eligible actions, and the evaluation criteria are determined solely by the Project and may be modified at any time.
The Project retains full discretion over the granting and calculation of Points, including the right to modify, revise, or invalidate Points without prior notice.
Users must follow any rules set by the Project when using Points.
Users waive any right to dispute the granting, calculation, or modification of their Points.
4. Eligibility for Participation
To participate in the Pheasant Points program, Users must meet all of the following conditions:
Be at least 18 years of age.
Not be a "U.S. Person" as defined under applicable U.S. law.
Ensure that participation in the program is not restricted or prohibited by the laws of their country or jurisdiction of residence.
The Project may restrict access to or participation in the program for Users in certain countries or regions in accordance with applicable laws and regulations. This may include the use of technical measures such as IP-based restrictions or wallet filtering. Users are solely responsible for confirming that participation is lawful in their jurisdiction.
5. Third-Party Service Integration
Certain features of the program may require Users to integrate external services, such as cryptocurrency wallets or third-party applications. The security, data handling, and terms of use of such third-party services are the sole responsibility of the respective providers. The Project assumes no liability for any issues arising from the use of these services. Users are strongly advised to review and understand the policies of each provider prior to integration.
6. Prohibited Conduct
Users are prohibited from engaging in the following activities:
Creating multiple accounts without authorization (e.g. Sybil attacks).
Abusing, tampering with, or otherwise disrupting the system.
Gaining unauthorized access to, or attempting to bypass, security measures.
Using bots or automated tools to acquire points through illegitimate means.
Generating artificial or deceptive activity logs via scripts or similar mechanisms.
Using another personβs account without permission, or colluding with others to manipulate the system.
Engaging in any point-receiving behavior contrary to the intended purpose of the program.
Performing any other actions deemed inappropriate by the Project.
Violating any applicable laws or infringing upon the rights of third parties.
If a User is found to have violated any of the above, the Project may take corrective measures, including but not limited to: point invalidation, account suspension, or pursuit of legal remedies.
7. Point Cancellation
If Users are found to have violated these Terms, or if the Project determines that any activity is fraudulent or inappropriate, the Project may cancel all or part of the Pheasant Points granted to that Users without prior notice.
8. Disclaimer
Users acknowledge that the Project and the Pheasant Points system are experimental in nature, do not guarantee any future value or rewards, and are used entirely at the User's own risk.
The Project shall not be held liable for any loss or damage arising from the granting, modification, invalidation, or deletion of Pheasant Points.
The Project reserves the right to modify the number of points granted, the rules of the program, or any other related terms at its sole discretion, including in response to technical issues, fraudulent behavior, or changes in project policy.
9. Limitation of Liability
To the fullest extent permitted by applicable law, the Project shall not be liable under any legal theory (including, without limitation, tort, contract, or strict liability) for any damages arising out of or in connection with the use of, or inability to use, the Project. Such damages include, but are not limited to:
indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, business interruption, loss of data, loss of goodwill, work stoppage, inaccuracies of results, or computer failure or malfunction;
the cost of procurement of substitute goods, services, or technology;
aggregate damages exceeding one hundred U.S. dollars (US$100); or
any matter beyond the reasonable control of the Project.
Some jurisdictions do not allow the exclusion or limitation of certain types of damages. In such cases, the above limitations may not apply to Users to the extent prohibited by law.
Any dispute arising out of or in connection with the Project shall be subject to the exclusive jurisdiction of the court designated by the Project, and the parties hereby irrevocably submit to such exclusive jurisdiction.
10. Amendment of Terms
The Project may amend these Terms at any time. Any such changes shall become effective upon being posted on the Projectβs related services.
